1. About these Terms
These Terms & Conditions (“Terms”) govern your access to and use of dread.agency and any content, tools or resources on it (the “Website”). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
“Dread Agency”, “we”, “us” and “our” refer to Dread Agency, a brand consultancy based in Alexandria, Egypt. “You” means any person or organisation using the Website.
2. Website only, not a service agreement
These Terms cover the Website only. Our branding, strategy, design and other services are governed solely by a separate written contract signed by both parties, including its scope of work. If that contract conflicts with these Terms, the contract prevails.
Nothing on the Website, including case studies, articles, timelines, or results described, is an offer to provide services. No engagement exists until a contract is signed.
3. Who can use the Website
You must be at least 18 years old, or the age of majority where you live, to book a call, apply for a role, subscribe, or submit information through the Website. If you use the Website on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
4. Acceptable use
You agree not to:
- use the Website for any unlawful, fraudulent or harmful purpose;
- copy, scrape or harvest content or data from the Website by automated means;
- attempt to access password-protected areas, servers or connected systems without authorisation;
- introduce viruses, malware or any code that may damage or disrupt the Website;
- impersonate any person or misrepresent your affiliation with any person or organisation;
- submit false or misleading information, or third-party information without permission.
We may suspend or restrict access to the Website, or any part of it, at any time without notice.
5. Intellectual property
All content on the Website, including text, graphics, the Dread Agency name and logo, visual identities, case studies, photography, video, layout and code, is owned by Dread Agency or used under licence, and is protected by intellectual property laws.
You may view the Website and share links to its pages. You may not reproduce, modify, distribute, sell, publicly display or create derivative works from any content without our prior written permission, except as these Terms expressly allow.
6. Portfolio and client work
The Website showcases work we created for clients. Rights in that work may belong to our clients under their agreements with us; we display it with their permission or as those agreements allow.
Client names, logos, and trademarks shown on the Website belong to their respective owners. Their appearance shows that we have worked with or for them. It does not mean they endorse Dread Agency unless stated.
Results and outcomes described in case studies reflect specific projects and circumstances. They do not guarantee similar results for you.
7. Password-protected case studies
Some case studies are password-protected and shared with selected viewers only. They may contain confidential client information. If you are given access, you agree to:
- keep the password private and not share it;
- not copy, screenshot, download, record, or distribute the content;
- use the content only to evaluate working with Dread Agency.
Access is personal to you and may be revoked at any time. If you received access by mistake, please close the page and tell us at [email protected].
8. Discovery calls and bookings
Discovery calls booked through the Website are free and carry no obligation on either side. Views shared on a call are general and given without a full review of your business; they are not professional advice, and you should not rely on them for business decisions.
Please don’t share confidential information before a non-disclosure agreement is signed. We treat what you share with discretion, but no confidentiality obligation arises without a signed agreement.
Bookings run through a third-party scheduling tool, subject to its own terms. Please reschedule or cancel at least 24 hours in advance using the link in your confirmation. If you miss a booking without notice more than once, we may decline further bookings. We may also decline or reschedule any booking at our discretion.
9. Enquiries and proposals
Messages sent through the Website, email or the booking tool are enquiries only. Proposals, quotes and timelines we send in reply are non-binding until included in a contract signed by both parties.
Proposals, strategies, concepts and creative ideas we share before an engagement remain our intellectual property. You may not use, implement, or pass them to third parties without a signed engagement with us.
10. Newsletter
If you subscribe, we will email you insights, updates on our work and information about our services. You can unsubscribe at any time using the link in any email.
11. Careers and job applications
Applying through the Website does not create any employment, freelance, or contractual relationship, and does not guarantee a response or interview. You confirm that the information and materials you submit are accurate and yours to share. Your portfolio remains yours; we use it only to assess your application.
12. Downloadable resources
Guides, templates, and other downloadable resources are licensed to you for personal or internal business use only. You may not resell, redistribute, sublicense, or publish them, or present them as your own, in whole or in part. They are provided “as is” for general information.
If a download asks for your email address, you agree to receive the resource and related emails, from which you can unsubscribe at any time.
13. Articles and insights
Articles and other content on the Website are for general information only. They are not professional, legal, financial or business advice for your situation, and may become outdated. You may quote short extracts with credit to Dread Agency and a link to the original.
14. What you send us
When you submit anything through the Website messages, briefs, files or applications, you confirm you have the right to share it and that it is lawful. You allow us to use it to respond to you, assess your request and run our business. We do not claim ownership of your materials.
15. Third-party links and tools
The Website links to and uses third-party services, such as social platforms, scheduling tools and analytics. We do not control them and are not responsible for their content, availability, or practices. Your use of them is subject to their own terms and privacy policies.
16. Privacy
Our Privacy Policy explains how we collect and use personal data, including through cookies, analytics, forms, bookings, newsletter sign-ups and job applications. Please read it alongside these Terms.
17. Disclaimer
The Website and its content are provided “as is” and “as available”. We work to keep information accurate and the Website available, but we do not warrant that it is complete, current, error-free, secure or uninterrupted. To the extent permitted by law, we disclaim all warranties, express or implied.
18. Limitation of liability
To the fullest extent permitted by law, Dread Agency is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, goodwill or opportunity, arising from your use of, or inability to use, the Website or its content.
Our total liability to you arising from the Website will not exceed USD 100 (or its equivalent in Egyptian pounds). Nothing in these Terms limits liability that cannot be limited by law, including for fraud or gross negligence.
19. Indemnity
You agree to indemnify Dread Agency against claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms, your misuse of the Website, or content you submit.
20. Governing law and disputes
These Terms are governed by the laws of the Arab Republic of Egypt.
We will first try to resolve any dispute amicably. If a dispute is not resolved within 30 days of written notice to [email protected], it will be finally settled by arbitration under the Egyptian Arbitration Law No. 27 of 1994. The seat of arbitration is Alexandria, Egypt; the tribunal will consist of a sole arbitrator; proceedings will be in English; and the award will be final and binding. Either party may seek urgent interim relief from a competent court.
21. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date above shows when they last changed. By continuing to use the Website after an update, you accept the revised Terms.
22. General
- Severability: If any part of these Terms is found invalid, the rest remains in effect.
- No waiver: if we do not enforce a right, we have not waived it.
